DUI Laws in California

The legal BAC limit for most drivers is 0.08% or higher. This means that if a driver aged 21 or older has a BAC of 0.08% or more, they are considered legally impaired and can be charged with a DUI.

For those operating commercial vehicles, the legal BAC limit is lower, set at 0.04% or higher. The stricter limit reflects the increased responsibility and potential risk associated with driving larger or more complex vehicles.

Furthermore, California enforces a zero-tolerance policy for underage drinking and driving. Drivers under the age of 21 are prohibited from having a BAC of 0.01% or higher. Any detectable alcohol in their system can lead to DUI charges and significant penalties.

Penalties for DUI convictions in California vary depending on whether it is a first, second, or subsequent offense. For a first offense, the fines range from $390 to $1,000, with a license suspension of 6 months, up to 6 months of jail time, and probation lasting 3 to 5 years. Offenders are also required to attend a 3-month DUI school, and an ignition interlock device (IID) may be installed.

A second offense within 10 years carries fines of $390 to $1,000, a 2-year license suspension, jail time ranging from 96 hours to 1 year, probation of 3 to 5 years, and a DUI school lasting 18 to 30 months, with a mandatory IID installation for up to 1 year. For a third offense within 10 years, the penalties include fines of $390 to $1,000, a 3-year license suspension, jail time from 120 days to 1 year, 3 to 5 years of probation, 30 months of DUI school, and a mandatory IID installation for up to 2 years.

Beyond the immediate legal penalties, DUI convictions in California carry additional consequences. Offenders may experience significantly increased auto insurance premiums and have a DUI conviction on their criminal record for 10 years, potentially affecting future employment and travel opportunities. Furthermore, the vehicle used in the DUI offense may be impounded, adding to the financial and logistical burdens faced by the offender.
