A California State Bar judge has recommended a two-year suspension from practicing law for former San Francisco deputy district attorney, Marc Guillory, who attempted to use his badge to avoid several DUI arrests.
Guillory was a San Francisco deputy district attorney from 2006 to 2012 and in that time managed to get convicted three times of misdemeanor DUI – in 2008, 2010 and 2012.
During the State Bar Court trial, which lasted six days, officer testimony revealed that Guillory attempted to use his deputy district attorney’s badge during each DUI arrest to request special treatment from the arresting officers.
Before becoming an attorney, Guillory suffered his first drunk driving conviction in 1999. He was convicted of misdemeanor reckless driving with alcohol involved after leaving a party and crashing into a stopped bus on the side of the street. Guillory’s cousin, who was his passenger, was killed in the accident.
After that incident and before obtaining his license to practice law, Guillory told a California State Bar examiner that he would never drive drunk again.
California State Bar Court judge Pat McElroy took Guillory’s promise into account when he issued his recommendation last week.
“Respondent’s repeated alcohol-related criminal conduct, which has spanned a period of 12 years or more, shows a wanton disregard for the safety of the public and abnegation by respondent of the duties that he owes to his fellow man,” wrote McElroy. “As a former DA who prosecuted DUIs, respondent is well aware of the wide swath of death, pain, grief, and untold physical and emotional injury that the drunk driver cuts across the roads of California and the rest of this country.”
The suspension will take effect once approved by the California Supreme Court.
