Two Cases Start Immediately After a DUI Arrest

Most people think they have “one DUI case.” In reality, a DUI arrest typically starts two matters on different tracks:

• The court case. This is where the prosecutor files charges and seeks penalties (probation terms, fines, programs, custody exposure). It ends through dismissal, reduction, a negotiated resolution, or trial.
• The DMV case. This is the license case. The DMV can suspend or restrict your license even while the court case is pending. In many DUI arrests, there is a short window to request a DMV hearing to challenge the suspension.
