Woman Gets No Jail Time for DUI Death

Back in mid-May, I posted on a Murrieta woman who had pleaded guilty to vehicular manslaughter. 19-year-old Ashly Nicole Rodriguez and several passengers had left a party where she had been drinking when her vehicle overturned. The victim, 19-year-old Aaron Michael Ellis, was fatally ejected from Rodriguez’s vehicle. It was later determined that Rodriguez’s blood alcohol content was 0.19%.

Sentencing took place on June 28th. Rodriguez was faced with 12 years in a California state prison. However, Rodriguez was sentenced to five years of probation and one year of treatment. Surprisingly, Judge Elaine Johnson’s sentence did not include any jail time. The judge acknowledged Rodriguez’s remorse, age and lack of criminal record in deciding the sentence.

Also in May post, I mentioned that Rodriguez and her passengers had come from a party hosted by a 20-year-old woman and her 41-year-old mother who provided alcohol to guests under the age of 21. At the time the case was referred to the Riverside District Attorney for possible criminal charges for the hosts. Since then, mother and daughter have been charged with misdemeanors for providing alcohol to minors.
