Drunk Driving Defense, DUI Arrest - FAQs
15. What are the consequences for driving while intoxicated?
There are many variables and factors involved in each case that can make this answer a little complicated. While the details of cases and penalties vary from court to court, a first offense (with no enhancements
, refer to #16) will include these penalties:
- A fine of, roughly, $1700
- 3, 6, or 9 months of enrollment and attendance at a DUI school
- Probation for three years
- 90 days of license restriction (Note: this is in addition to the DMV suspension you may receive)
- A jail sentence could possibly be included as well
Second offenders will almost definitely receive a jail sentence. Other consequences involved might include community service, AA meetings, ignition interlock devices, and/or impounding of the vehicle.
